The constitutional freedom of the Iraqi citizen to move, live and travel

    The Iraqi Constitution guaranteed the Iraqi freedom of movement, travel and housing, whether inside or outside Iraq, and this did not comment on the issuance of a law regulating these rights, but considered them one of the basic rights that must be guaranteed to the Iraqi citizen in accordance with the provisions of Article (44) of the Constitution, so all state institutions, whether subject to the federal authorities, the region or the governorates that are not organized in the region, should not follow any method or procedure that leads to the Iraqi citizen not enjoying these rights, especially since Article ( 23/3rd/Alif) of the Constitution of the Republic of Iraq has allowed Iraqis the right to own real estate and movable property anywhere in Iraq, which requires that no law, regulation or instructions be enacted contrary to the provisions of the aforementioned constitutional articles, and that this is in accordance with international conventions and declarations regarding freedom of movement, travel and residence.

Guaranteeing the freedom of a person to move from one region to another within his country or to leave or return to it without restriction limits this is part of the general concept of freedom guaranteed by constitutions in most countries of the world as indicated by many international conventions.

One of the principles stipulated in the Constitution of the Republic of Iraq for the year 2005 is article 44 thereof, which stipulates the freedom of movement of Iraqis to travel, live inside and outside the country, and that it is not permissible to exile, deport or deprive the Iraqi of returning to the homeland, which is one of the basic rights that must be guaranteed and not violated, and that the right of a citizen to obtain and carry a passport reflects one of the tributaries of his personal freedom and an expression of his right to citizenship.

A passport is a document issued by the State to an Iraqi in order to be able to exercise his constitutional right to travel outside Iraq and return to it.
