The Federal Supreme Court: Unconstitutionality of clause sixth of Article 35 of the Pension Law

The Federal Supreme Court decided that one of the provisions of the Unified Pension Law No. 9 of 2014 regarding the retirement pension of ambassadors is unconstitutional, and confirmed that its legislation was contrary to what was stipulated in the constitution.

 

Judge Abdul Sattar Berqadar said that "the Federal Supreme Court held its session today, Monday, and examined the cases before it."

Bayrakdar added, "The court decided that clause (6th) of Article 35 of the Unified Pension Law No. 9 of 2014 is unconstitutional."

He added, "This clause relates to the ambassador's entitlement, upon retirement, to a pension salary of 80% of the salary and the allowances that his peers receive in the Ministry's center, provided that the allocations do not exceed 100% of the job salary."

He explained that "this clause came from the Council of Representatives and was not present in the draft budget law and the Council of Representatives didn’t referred to the Council of Ministers in the stipulation of this text, although it involves a financial affliction."
