Federal Supreme Court issues the decision of challenging Iraqi media network law

   The Federal Supreme Court on Monday decided the lawsuits challenging the Iraqi Media Network Law No. 26 of 2015.

"The Federal Supreme Court today heard the challenges against the Iraqi Media Network Law," said Judge Abdul Sattar Berkdar, spokesman for the federal judiciary.

 

 

"The court has seen the report of the competent experts who assigned them and what they based on their experience, and found that the challenge concerned three axes," Berkdar said.

 

"The first axis concerns the financial aspect and the changes made by the Council of Representatives to the bill sent by the Council of Ministers from this side, and concluded that the Council of Representatives should have referred to the Council of Ministers before adding any financial burden to the government that makes it unable to implement it as responsible for implementing the budget, including increasing the members of the Board of Trustees from six to nine members and finding a new oversight body on the Iraqi media network," he said.

 

"This is not following article (62/2nd) of the Constitution and Article (31) of the Bylaw and therefore decided to repeal the articles of the law concerning the addition of new members to the budget without referring to the Council of Ministers," he said.

 

"The second axis relates to the link between the network and the court found that this link is related to the policy-making of any independent body and not interference in its affairs, and the court found that the association of the Iraqi media network in the Council of Representatives was a claim to achieve neutrality and secure the goal and therefore the case was dismissed from this side," he said.

 

As for the nomination, Berkdar said that "the court found that the nomination should not be to and from the House of Representatives, but the executive power following the provisions of article (47) of the Constitution."

 

"The third axis relates to the age of the members of the Board of Trustees, which was set by the Council of Representatives, and the court found that it was a legislative option and there was no violation of the constitution, so the case was decided as much as that axis," he said.

 

"The court decided to dismiss the lawsuit against the President of the Republic regarding the law because the antagonism was not directed," he said.
