The Federal Supreme Court rejected a candidate's case challenged the wining of a representative by advantage of one vote in the elections

The Federal Supreme Court rejected a case initiated by a loser candidate for challenging the wining of a representative by advantage of one vote in the public elections of membership of Iraqi Council of Representatives.

The official spokesman of the court Ayas AL-Samouk " Federal Supreme Court had convened its session headed by the judge Midhat AL-Mahmood, and the presence of all the judges the members, and tried a case initiated by a loser candidate for challenging the wining of the representative Shamail Sahab Mutar".

AL-Samouk added " the plaintiff requested from the court to adopt its wining in the elections after annulling the defendant membership, whereas the challenge relied on two points, first point that the results of the counting which made Shamail Sahab a representative were not announced. The second, there is a station mentioned in the issued decision from the judicial committee at the federal court of cassation No.(144309) despite the absence of this station in reality."

He referred " the court confirmed that for the point related to unannounced elections' results, it had been proved the announcing of the winning results for the candidate Shamail Sahab for getting (626)  votes, while her competitor the plaintiff got (625) votes by advantage of one vote."

He explained " Federal Supreme Court confirmed the ratification of the elections' results by its decision No.(57/Ta.Qaf/2018) on 19/8/2018"

He clarified "the court and for the above, decided to reject the plaintiff's case for not relying on substantiation from the Constitution and law."
