The Federal Supreme Court: arresting is an exclusive competence of the Judiciary

The Federal Supreme Court had confirmed that no individual shall be arrested or investigating with, but with a judicial decision. Emphasizing, the judiciary is independent and not to intervene its competences.

The spokesman of the Court Ayas Al-Samouk said ((the Court confirmed in its judgments that no individual shall be arrested or investigating with, but with a judicial decision according to the article (37) of the valid Constitution)).

Al-Samouk added ((a number of judgments issued by the Federal Supreme Court adjudge by unconstitutionality of articles in laws which granted the power of arresting the accused except by the judges)).

He pointed ((among these judgments, the judgment No. (15/2011) which the Court adjudged by unconstitutionality of article (237) of customs law No. (23) For 1984. This article stipulated (the arresting order shall be issued by the General Director or whom he authorizes by that, the arrested shall be referred to the customs Court within three days from the date of his arresting).

He clarified, the Federal Supreme Court confirmed that the article (37) of the Constitution has the superiority in implementation, worthy to mention that the Court had always sought for the independence of the Judiciary and not to intervene its competences
